A Sex Crime is any misdemeanor or felony of sexual nature. Sex Crimes fall into a multitude of areas including:
- Child sexual abuse
- Date rape
- Statutory Rape
- Lewd conduct
- Lewd acts with a child
- Oral copulation by force
- Possession of child pornography
- Sexual Battery
If you are being investigated or have been charged with any of these allegations, it is imperative you remain silent until you discuss your matter with a Defense Attorney.
A pending investigation should not be discussed with a Detective, Police or District Attorney. It should also be noted that speaking with a Psychologist or Psychiatrist, is not privileged in the State of California. A Psychologist is able to discuss admissions made by their client (Tarasoff rule), and any admissions to these offenses assist in the filing of charges, by a Prosecuting entity or District Attorney’s Office.
These cases are extremely serious, as they can hold a multitude of years in State Prison and sexual registration (often for life) pursuant to Penal Code 290.
Additional Consequences may include a ban on possessing firearms and the inability to expunge the conviction.
At Kassel & Kassel Law Offices, we understand the severity of these allegations may bring upon a defendant. Our office offers free and confidential consultations.
